Changes to SAHRIS!

Following comments received on the proposed Revised Schedule of Fees for applications made to the South African Heritage Resources Agency (SAHRA), made in terms of Section 25(2)(l) of the National Heritage Resources Act No. 25 of 1999 (NHRA) and published in the Government Gazette of 22 July 2022, SAHRA hereby publishes the final Revised Schedule of Fees for Applications made to SAHRA. Applications for provision of services submitted to the South African Heritage Resources Authority (SAHRA), in terms of the National Heritage Resources Act, No. 25 of 1999 (NHRA) must be accompanied by a payment of the appropriate fee, taking effect from 1 January 2023

Expanded_Motivation: 

1. PURPOSE OF SUBMISSION. 1.1. The purpose of the request is: 1.1.1. To obtain consent from AMAFA to build a residential house on the vacant land known as 23 Sunnyside Road, Seaview. . 2. BACKGROUND. 2.1. The above property known as 23 Sunnyside Road, Seaview, Durban (Rem of Portion 4 of Erf 49) with an extent of 2174 square meters of land which consisted of an area of 266 square meters for the house structure, under Title Deed 13435 of which the original date of approval of plan was dated 6 March 1926 was owned by my aunt JA Fourie. 2.2. The property is thus over 60 years old. 2.3. The property was occupied by the owner and during January 2021, a fire broke out which took her life and destroyed the entire house with all her possessions. There are no remnants of any structure left as can be seen on the photo’s that I will attach as part of the application as required by AMAFA. I unfortunately do not have any photos of the house before it was burnt down. She also do not have any insurances so a decision was made by the beneficiaries (My dad and his brother’s children) that we should sell the land. 2.4. When I applied to the Master of the Court for a letter of Authority, they advised me that they require a valuation of the property and I requested such from the EThekwini Municipality. The Municipality advised me that they will do the inspection on the site and I was then provided with the valuation and the property category was changed to vacant land as there was no structure left (See Annexure C – Tax invoice). The rates was also subsequently adjusted from below R400 per month to R2162, 09 as such was considered vacant land. 2.5. I was only given the Letter of Authority by the Masters Court (as the value of the land is marked as R200 000) on the 26 July 2022 to handle my aunts affairs as she was never married or had no children (See Annexure A – Letter of Authority, JA Fourie Death Certificate and a copy of my ID Document and Annexure D – Valuation Certificate). 2.6. I then approached an agent to sell the land and they did receive an offer from a prospective buyer on the condition that I ensure that AMAFA has no objection to the future construction of a house on the property. 2.7. On investigation, I was informed by AMAFA that although the property is not listed (not permanently protected) as having historical or architectural significance, the land is over 60 years old and consent is thus required from AMAFA to ensure that they have no objection to build a new house on the land (Refer to e-mail from AMAFA Annexed B). 2.8. I further investigated with EThekwini Engineering Department and they confirmed that the site is reflected as Zone: Special Residential 400 which does allow for a residential house to be built on the vacant land (See Annexure F). 2.9. No plans for the construction of any house has yet been drafted as I first need consent from AMAFA that they have no objection that another house may be built on the land. Once such is received, it will be provided to the Estate Agent so that the transfer and registration of the property can be done into the name of the new owner. Once such is done, the new owner will get plans drafted and submitted to the Engineering Department for approval of such in terms of the allowed Special Residential 400 zone. 3. HISTORICAL SIGNIFICANCE 3.1. The original house was destroyed by fire and there are no remnants left of the structure. AMAFA indicated (Refer to attachments above) that the property was not permanently protected (listed). Also see Annexure G which is a copy of the Title Deed. 4. ARCHITECTURAL SIGNIFICANCE 4.1. As can see above the entire building was burnt down and therefore there is no existing architectural significance (Annexure E refers to photos of the vacant land). 4.2. Annexed H refers to the plan of the initial proposed cottage that was build. 5. URBAN SETTING & ADJOINING PROPERTIES 5.1. As indicated above the zoning for the area is Special residential 400. 5.2. The land is situated next to a houses on both sides as well as opposite the street. 5.3. The adjacent properties is also possibly over 60 years old. 6. RECOMMENDATIONS. That consent be received from AMAFA to not have any objection with the building of a residential house as per allowance of the special residential (400) zoning and relevant procedure to be followed for approval of drawings by the Engineering Department on the vacant land situated at 23 Sunnyside Road, Seaview, Durban.
