Conditions:

1. It must first be established to the satisfaction of the archaeologist whether or not MHC021 is an unmarked grave before mining commences in the area. Secondly a decision must be taken as to whether it will be protected and fenced or relocated. If the former, it will need an appropriate buffer to be determined by the archaeologist (at least ten metres around the grave) and a fence. A permit will have to be applied for if the decision is to move the grave at MHC021.
2. SAHRA recommends that sites MHC017 and MHC024 noted in the impact assessment (June 2007) as having graves present (some thought to be modern), but which fall outside the development footprint, should be fenced off for protection.
3. MHC002 requires further assessment by an ESA specialist and any investigation of the recorded ESA at this site, must be investigated by an archaeologist with the relevant Stone Age experience.
4. The significant Iron Age farming sites, specifically MHC001, 002, and MHC004, must be mitigated (recorded, sampled and dated).
5. If the permit holder is not to be present on the site at all times then SAHRA must be provided with the names and qualifications of the authorised representatives.
6. Adequate recording methods as specified in the Regulations and Guidelines pertaining to the National Heritage Resources Act must be used. Note that the position of all excavations must be marked on a plan of each site.
7. A standard site record form must be lodged with the National Cultural History Museum.
8. All material collected and excavated, as well as field notes and records, will be curated by the University of Witwatersrand.
9. A report must be submitted to SAHRA on or before 1 May 2009. SAHRA reserves the right to withhold further permits if progress is not deemed satisfactory.
10. Reprints of all published papers, or copies of theses or reports resulting from this work must be lodged with SAHRA.

11. If a published report has not appeared within three years of the lapsing of this permit, the report required in terms of the permit will be made available to researchers on request.
12. It is the responsibility of the permit holder to obtain permission from the landowner for each visit, and conditions of access imposed by the landowner must be observed.
13. It is the responsibility of the permit holder to fill in excavations and protect sites during and after excavation to the satisfaction of SAHRA and the landowner.
14. SAHRA shall not be liable for any losses, damages or injuries to persons or properties as a result of any activities in connection with this permit.
15. SAHRA reserves the right to cancel this permit by notice to the permit holder.
16. This permit is subject to a general appeal and may be suspended should an appeal against the decisions be received by SAHRA within 14 days from the date of the permit. SAHRA may not be held responsible for any costs or losses incurred in the event of the suspension or retraction of this permit.
