Changes to SAHRIS!

Following comments received on the proposed Revised Schedule of Fees for applications made to the South African Heritage Resources Agency (SAHRA), made in terms of Section 25(2)(l) of the National Heritage Resources Act No. 25 of 1999 (NHRA) and published in the Government Gazette of 22 July 2022, SAHRA hereby publishes the final Revised Schedule of Fees for Applications made to SAHRA. Applications for provision of services submitted to the South African Heritage Resources Authority (SAHRA), in terms of the National Heritage Resources Act, No. 25 of 1999 (NHRA) must be accompanied by a payment of the appropriate fee, taking effect from 1 January 2023

The proposed project entails a General Authorisation application to the Department of Water and Sanitation in terms of Section 21 (c )and (i) of the National Water Act (36 of 1998) for the proposed construction of a KFC food outlet which will be located on Erf 239, No. 0335 along Rogers Street, off the R102 in the town of Tongaat, within the eThekwini Metropolitan Municipality, KwaZulu-Natal.

Expanded_Motivation: 

An Environmental Impact Assessment (EIA) Enquiry was sent to the Department of Economic Development, Tourism and Environmental Affairs (EDTEA) requesting confirmation on whether the proposed construction of the KFC food outlet in Tongaat would trigger the need for Environmental Authorisation. The proposed development does not trigger any of the Heritage Resources Listed Activities as the proposed development will result in an area of approximately 1700 metres squared, and as such, did not require a heritage impact assessment to be conducted. It was confirmed that proposed development does not trigger any activities listed in terms of the NEMA EIA Regulations of 2014 as amended, and as such, Environmental Authorisation was not required. Authorisation is, however, required in terms of the National Water Act (36 of 1998) due to the presence of two (2) watercourses located within 500m of the proposed development. These watercourses are, however, located outside of the 32m buffer. Assessment of these watercourses revealed that they would not be at risk due to them being loacted more than 40m away from the development, and due to the Risk Assessment Matrix which shows that all potential impacts can be mitigated to "low risk". The application has thus been submitted to the Department of Water and Sanitation and has now been distributed to all Interested and Affected Parties for comment.
