ProposalDescription:

On the 26th of May 2021, the HPU received a complained by the Nyapotse Inc Attorneys, representing the Rooibokfontien Relocation Committee.

Expanded_Motivation:

On the 9th of June 2021, the HPU met with Anglo American Mine: Mogala Kwena Mine, Internal Archaeologists and the family representative. It was stated in the meeting that the process started in 2019, and they had appointed PGS Consulting company to do a study. The study stated that the site had +-167 graves on the site. An HIA was done in 2002 by Julius Pretorius. The public consultations were done with the community members and there was an intentional resistance against the relocation of the graves. The community members stated that the graves will not be removed until their demands have been met. The mine has plans of developing the local community, viz; Installation of Solar, Water Supply, School maintenance, Grading and maintenance of the road. However, the mine is still in consultation phase and only 10 families have agreed for the relocation. The mine is willing to compensate R10 000 per grave. The Mine has stated that they do not have a problem with the community members coming on site to perform the rituals, however, the mine needs to be informed on time. The delegation proceeded to do a site visit. Upon arrival the team could only identify one grave and the family member stated that some of the graves are under the mine dump. It is alleged that the mine has been dumping on some of the graves. • It is recommended that the mine should forward all the studies to SAHRA. • To send SAHRA the Long demands made by the community members. • To outline all the intended projects (short and Long Term)
