Case Type:

ProposalDescription:

Relocation of graves at Bloemkrans Portion 1 to pave way for the construction of the Rail link between Davel and Richards Bay through Swaziland. The Burial ground on the Farm Bloemkrans Portion 1 is located within the corridor of the propsed development.

Expanded_Motivation:

A comprehensive situation analysis has been conducted relying heavily on a public participation process. The burial ground on the Farm Bloemkran Portion 1 holds 13 individuals. Five families have been identified represented by Mxolisi Mathebula, Sarah Mnisi, Wuta Nkosi, Stanford Vilakazi and Flora Ngema together accounting for seven (7) graves. These will require health department permitting in terms of the Human Tissues Act (No 65/1983) and supporting regulations. However the next of kin for six (6) graves have not been identified, suggesting they are much older, possibly more than 60 years, which has entailed the Msukaligwa Local Municipality to act as custodian of the graves for purposes permitting in terms of Section 36 of National Heritage Resources Act (No 25/1999). A letter of commitment by the local Municipality is therefore attached to the application.
