Underwater Cultural Heritage and International Law

A recently published book that can spread light on South Africa's underwater cultural heritage management and maritime heritage protection is a monograph by Sarah Dromgoole entitled Underwater Cultural Heritage and International Law (Cambridge University Press, 2013). The author is Professor of Maritime Law at the University of Nottingham, UK, and is widely known for her work in the field.

The book is a comprehensive thematic study of the international legal framework governing underwater cultural heritage post the coming into force of the 2001 UNESCO Convention.  The book takes as its main themes the issues that posed the greatest challenges to the UNESCO Convention negotiators and uses those issues to explore the current legal position inside, and outside, the regime of the 2001 Convention.

These issues include the question of ownership rights in sunken vessels and cargoes; the legal status of sunken warships; the application of salvage law to heritage assets and the ethics of commercial exploitation; as well as the question of jurisdictional competence to regulate activities beyond the 12-mile territorial limit. The book also explores other aspects of the 2001 Convention’s regime, including the questions of how the Convention should be implemented from a practical perspective and how its regime impacts upon marine development activities.  It is written to be accessible to a wide readership, including those with non-legal backgrounds.
