Conditions:
The MUCH Unit at SAHRA is pleased to approve the abovementioned permit application. The permit is issued under condition of compliance with the following:
1. If the permit holder is not present on the site at all times, the SAHRA must be provided with the names and contact details of his/her authorised representative(s).
2. This permit gives the holder and/or his/her authorised representative(s) the sole right to work on the site of the Kalk Bay Harbour marine structure, quay furniture, slipways, quay crane, breakwater, and harbour basin for the duration of the permit period.
3. All works must be limited to the activities described in the Project Description and its appendices. All activities undertaken must be for the sole purpose of
- Concrete repair and maintenance of existing marine structures;
- Maintenance and repair of quay furniture;
- Repair and maintenance of the harbour slipways;
- Replacement of the quay crane;
- Breakwater concrete cap and wave wall repairs; and
- Maintenance dredging of isolated areas in the harbour basin.
4. This permit does not give authorisation for damage/disturbance of any cultural heritage material not mentioned in (3) above. In particular, permission is not hereby granted for the disturbance of any shipwrecks whatsoever. The permit holder must take cognisance of the presence of approximately seven historical shipwrecks located in the harbour. Special care must be taken in proposed dredging area two (2) shown in Appendix C of the Project Description, since as many as three of the shipwrecks may be located in this area. All proposed dredging areas must be inspected by means of seabed sidescan insonation prior to dredging to confirm that no shipwrecks will be disturbed.
5. Should any cultural heritage material not mentioned in (3) be discovered and be at risk of damage/disturbance as the result of the activities undertaken under the authority of this permit, SAHRA must be notified immediately and work must cease and may not commence until feedback has been received from SAHRA. Should any shipwrecks be discovered during the pre-dredge survey mentioned in (4), SAHRA must be informed of their location and this information must be included in the permit report mentioned in (9).
6. It is the responsibility of the permit holder or her authorised representative to obtain permission from the landowner for each visit, and conditions of access imposed by the landowner must be observed.
7. SAHRA shall not be liable for any losses, damages or injuries to persons or properties as a result of any activities in connection with this permit.
8. SAHRA reserves the right to cancel this permit by notice to the permit holder.
9. The closing report for works in the Kalk Bay harbour must be made available to SAHRA within one month of the expiry of this permit. The permit report must be accompanied by the survey data and analysis mentioned in (4).
