Changes to SAHRIS!

Following comments received on the proposed Revised Schedule of Fees for applications made to the South African Heritage Resources Agency (SAHRA), made in terms of Section 25(2)(l) of the National Heritage Resources Act No. 25 of 1999 (NHRA) and published in the Government Gazette of 22 July 2022, SAHRA hereby publishes the final Revised Schedule of Fees for Applications made to SAHRA. Applications for provision of services submitted to the South African Heritage Resources Authority (SAHRA), in terms of the National Heritage Resources Act, No. 25 of 1999 (NHRA) must be accompanied by a payment of the appropriate fee, taking effect from 1 January 2023

Afzelia Environmental Consultants (Pty) Ltd was appointed by Anderson Vogt Consulting Engineers on behalf of the (Client) Nquthu Local Municipality to conduct an Environmental Impact Assessment (EIA) in the form a Basic Assessment (BA) and Water Use Authorisation application. The proposed project involves the upgrading of the existing track (north-west of the Sibiyela River) from the T-junction with road D1301 and the existing gravel Road L1970 at the South-east side of the Sibiyela River to a formalised gravel road. The upgrading of the existing track, that is situated north-west of the Sibiyela River will start from the T-junction with road D1301 at approximately GPS Coordinates: 28°13'31.46"S 30°46'11.53"E; and end at 28°13'29.2"S 30°47'45.0"E approximately 260m from the Sibiyela river-crossing. The road length is 2.89 km and the total width is 8.4m (width of compacted gravel surfacing: 5 m) with a road reserve of 12m and will be resurfaced to a Class 4 gravel road according to KZN Department of Transport gravel road standards. The upgrading of the existing gravel Road L1970 commences from the Mfihlelwane Primary School at approximately GPS Coordinates: 28°14'16.19"S 30°48'20.66"E; and ends at 28°13'49.8"S 30°48'46.3"E. The road length is 1.67 km and the total width is 8.4m (width of compacted gravel surfacing: 5 m) with a road reserve of 12m and will be resurfaced to a Class 4 gravel road according to the KZN Department of Transport gravel road standards. It is proposed to place a concrete slab (25x6x0.15) and several stormwater pipe infrastructures on both sections of the road of 600 mm and 900mm diameter in size and will occur at different positions as a stormwater control measure. In addition, mitre drains are used at different intervals for stormwater runoff control.

Expanded_Motivation: 

The Department of Economic Development, Tourism and Environmental Affairs (DEDTEA) in their correspondence dated 27/10/2016 (Refer to uploaded document) gave exemption to Nquthu Local Municipality for the upgrade of the existing gravel road L1970 at the South-east side of the Sibiyela River, as it does not constitute an activity which is identified in terms of sections 24(2) and 24D of National Environmental Management Act (NEMA) (No. 107 of 1998) and therefore, does not require an Environmental Authorisation. The upgrade of the existing track (2.89 km in length) from the T-junction with Road D1301 at the North-west side of the Sibiyela River did not form part of the exemption. The road upgrade application is a community based project that is funded by a Government Grant. Nquthu Local Municipality was under pressure to show expenditure to the Municipal Infrastructure Grant (MIG). The Municipality then appointed Anderson Vogt Consulting Engineers as the Project Manager’s and instructed them to continue with construction activities on the existing track at the North-west side of the Sibiyela River, however these area of construction activities was not included in the exemption letter by DEDTEA dated 27/10/2016. A directive in terms of section 28(4) of NEMA (No. 107 of 1998) as amended in respect of the upgrade of existing track (2.89 km in length) and gravel road L1970 (1.67km in length) in Mantuli was issued by DEDTEA to the Nquthu Local Municipality on 12/01/2017 (Refer to uploaded document) to cease construction activities pending the application outcome. The upgrade of the road and installation of new stormwater drainage infrastructure will improve road access for the local residents, improve road drainage systems and create employment opportunities to the previously disadvantaged local communities during the construction phase of the project.
