Conditions:

The South African Heritage Resources Agency (SAHRA) would like to inform you that after careful deliberation it has been decided to approve your application for a permit to export the artwork, 'Prince Albert' also known as 'Landscape, Flowers and Mountains'.

SAHRA had initially identified 'Landscape, Flowers and Mountains' as a significant artwork that forms part of the National Estate and decided to refuse a permit to export the artwork.  Subsequently, new information has come to light that necessitated a re-assessment of the significance of the artwork.  In the process of doing so, it emerged that Bonhams Auction House, London who had initially applied for an export permit on 31 July 2014 gave it what they term "a purely descriptive working title of ‘Landscape, Flowers and Mountains’, After that date they discovered the feint pencil inscription on the back of the painting'...buite...en Prins Albert', where-after, they amended the title in order to identify the location as 'Prins Albert'.   According to them, they never offered it for sale as ‘Landscape, Flowers and Mountains’, but rather ‘Prins Albert’ in their 1 October 2014 sale and now ‘Mountains, Prins Albert’ in their upcoming sale on 18 March 2015.  However, Mr Hoogenhout had applied for a permit to export the artwork titled, 'Landscape, Flowers and Mountains'.  Having noted these title changes to the artwork, SAHRA agrees to issue a permit for its export.

The following conditions apply:

  1. The South African Heritage Resources Agency must be informed if the object is not exported.
  2. The South African Heritage Resources Agency shall not be liable for any losses, damages, or injuries to persons or properties as a result of any activities in connection with this permit.
  3. In accordance with the application received on 25 February 2015, should any appeal against the issuing of this permit be received by SAHRA within fourteen days of the date of this permit, the permit will be suspended pending the outcome of the appeal.
  4. SAHRA will not be held liable for any losses incurred resulting from the suspension of the permit.
